- ilcd;;2:16-cv-02108_de185 RegisterActionDescriptionText "TEXT ORDER entered by Judge Harold A. Baker on 1/4/19. Plaintiff has filed 134 , a motion to recuse the trial judge. Plaintiff asserts that the court "lied" when it advised that it would attempt to recruit counsel on his behalf. The court, of course, does not have the authority to require an attorney to accept pro bono appointments on civil cases such as this. Pruitt v. Mote, 503 F.3d 647, 653 (7th Cir. 2007). The most that the Court can do is to ask for volunteer counsel. Jackson v. County of McLean, 953 F.2d 1070, 1071 (7th Cir. 1992)(holding that it is a fundamental premise that indigent civil litigants have no constitutional or statutory right to be represented by counsel in federal court). The court advised Plaintiff at the time of the 1/4/19 status telephone conference, that it has twice referred the case to the litigation coordinator in an attempt to recruit counsel. While so far unsuccessful, these efforts continue. The court is hopeful that counsel will have been recruited by the next schedule conference. The 3/5/19 trial date remains as scheduled at this time. Plaintiff's 134 is DENIED as he fails to allege actual bias or personal animus on the part of the court. (TC, ilcd) Modified on 1/4/19 to add last sentence (TC, ilcd).
