- ilcd;;4:16-cv-04127_de63 RegisterActionDescriptionText "TEXT ORDER entered by Chief Judge James E. Shadid on 6/5/2018. Plaintiff has filed a motion for appointment of counsel. 41 Plaintiff has no constitutional right to the appointment of counsel. In addition, the Court cannot require an attorney to accept pro bono appointment in a civil case. The most the Court can do is ask for volunteer counsel. See Jackson v. County of McLean, 953 F.2d 1070, 1071 (7th Cir. 1992). In considering Plaintiffs motion, the Court must ask two questions: "(1) has the indigent plaintiff made a reasonable attempt to obtain counsel or been effectively precluded from doing so; and if so, (2) given the difficulty of the case, does the plaintiff appear competent to litigate it himself?" Pruitt v. Mote, 503 F.3d 647, 654 (7th Cir. 2007), citing Farmer v. Haas, 990 F.2d 319, 322 (7th Cir. 1993). In this case, Plaintiff has not demonstrated any effort to find counsel on his own such as a list of attorneys contacted or copies of letters sent or received. Therefore, his motion is denied. 41 . The Court notes even if the Plaintiff made a reasonable attempt to find counsel, he has one claim of excessive force which is not complex. Further, Plaintiff's motion for appointment of counsel, complete with legal citations, demonstrates he is capable of representing himself; and Plaintiff has further demonstrated he already has access to several documents in his initial filings. 1 , 22 Finally, Plaintiff says he needs an attorney to obtain video footage, but Plaintiff admits Defendants state there is no relevant recording. For clarification of the record, Defendants must state whether there ever was a recording of the alleged incident. In addition, if there was a recording, but it no longer exists, Defendants must explain why it no longer exists. Defendants must respond within 21 days. (SAG, ilcd) (Entered: 06/05/2018)" @default.
