- ilnd;;1:02-cv-01049_de0 RegisterActionDescriptionText "ORDER OF THE EXECUTIVE COMMITTEE dated 2/14/02: It appearing that there are currently twenty-seven asbestos cases pending before various judges of this Court in which a request has been made that the Executive Committee assign all of these cases to a single judge of this Court for the purpose of handling pretrial matters; and It further appearing that the Executive Committee has determined that it would be in the best interests of efficient judicial administration to establish a coordinated pretrial proceeding pursuant to IOP13(e) of this Court's Internal Operating Procedures, therefore IT IS HEREBY ORDERED AS FOLLOWS: 1. A consolidated pretrial proceeding is established pursuant to IOP13(e) of this Court's Internal Operating Procedures which will be referred to as the In re Garlock, Inc., et al. Consolidated Pretrial Proceeding. 2. Documents pertaining to the consolidated pretrial proceeding will be captioned in the same manner as this order. When a document is intended to be applicable to all of the actions included in the consolidated pretrial proceeding, the words "ALL ACTIONS" shall be included in the caption below the case number. When a document is intended to be applicable to fewer than all of the actions in the consolidated pretrial proceeding, the name or names of the plaintiffs and the case number or numbers of each action to which it applies shall be included in the caption. 3. The twenty-seven cases included on the attached list are each included in the consolidated pretrial proceeding. Each of the cases will remain on the calendar of the judge to whom it is assigned. The judge designated supervisory judge will hear all matters associated with a consolidated motion to dismiss that raises legal issues common to all cases, and coordinate pretrial discovery matters, provided that where a matter does not arise out of or is not related to a consolidated motion to dismiss or discovery, pretrial, or settlement, the supervisory judge may determine that it should be heard by the assigned judge. 4. The Committee designates the Honorable John W. Darrah, the judge to whom the earliest numbered case among the twenty-seven is assigned, to act as the supervisory judge for this consolidated pretrial proceeding. 5. The Clerk will assign case number 02 C 1049 to the consolidated pretrial proceeding and maintain a separate docket for the proceeding. The Clerk will also have entered on each of the dockets of the individual cases an entry indicating that the case is part of the consolidated pretrial proceeding and that all matters pertaining to the proceeding are docketed in 02 C 1049. A list of the titles and case numbers of each of the cases included in the consolidated pretrial proceeding will be maintained with the docket for that proceeding (02 C 1049). Except as otherwise ordered, documents pertaining to the consolidated pretrial proceeding will only be entered on the consolidated pretrial docket. 6. Appearances filed in the actions included in the attached list and in any action that might subsequently be included in this proceeding shall serve as appearances in this action. 7. While the consolidated pretrial proceeding is pending the Honorable Morton Denlow, the designated magistrate judge in the earliest numbered case among the twenty-seven, will be the designated magistrate judge for the purpose of any referrals made in the consolidated pretrial proceeding. 8. The Clerk is directed to mail a copy of this order to each of the counsel of records in this action (Attachment). Mailed notice in individual cases.
