Although the court sympathizes with plaintiffs for having expended "huge sums of money in this case," self-inflicted injuries do not give rise to constitutional standing. It is true, as plaintiffs observe, that a threat directed toward a specific victim can support criminal liability, even where it appears very unlikely that the defendant has the ability to make good on the threat. This observation, however, is of no help to plaintiffs. First, they allege no specific threat. Second, unlike the government in a criminal case, an individual seeking preemptively to invoke the power of a federal court must show an imminent threat of future injury.
