- ilnd;;1:02-cv-07495_de15 RegisterActionDescriptionText "MINUTE ORDER of 12/12/02 by Hon. William J. Hibbler : On 10/22/02, the Court remanded this case to the Circuit Court of Cook County, finding it lacked federal subject matter jurisdiction. Defendant has appealed that decision, and now seeks leave to proceed in forma paupris on appeal. Pursuant to 28 U.S.C. 1915(a)(3), this Court must determine whether defendant's appeal is taken in good faith. The Court concludes it is not. The Court clearly and concisely pointed out in its written order why this case could not proceed in federal court. However, Defendant has made no real attempt to show any error on the Court's part. His appeal is therefore meritless. See Lee v Clinton, 209 F.3d 1025, 1026 (7th Cir. 2000). Accordingly, the Court certifies that the appeal is not taken in good faith, and thus denies defendant's request to appeal in forma pauperis [12-1]. Mailed notice (ntf) (Entered: 12/17/2002)" @default.
