- ilnd;;1:03-cr-01201_de93 RegisterActionDescriptionText "MINUTE entry before Judge James F. Holderman :Defendant D6520A8 filed an "Addition to Attorneys Sentencing Memorandum" (Dkt. No. 82) on May 8, 2007, five months after the Seventh Circuit Court of Appeals upheld this courts sentencing of Kwan to 77 months" imprisonment. In the "Addition to Attorney's Sentencing Memorandum," Kwan asks the court to use its discretion under United States v. Booker, 543 U.S. 220 (2005), to impose a sentence below the advisory guidelines range. Defendant's request comes too late; the court has already imposed a sentence and that sentence has been upheld by the Seventh Circuit. Defendant's only remaining option is to file a motion under 28 U.S.C. § 2255 to vacate, set aside, or correct his sentence. Because defendant has only one opportunity to file a § 2255 motion before facing restrictions on any subsequent § 2255 motions, the court does not interpret his "Addition to Attorney's Sentencing Memorandum" as a § 2255 motion. See Castro v. United States, 540 U.S. 375, 383, 124 S. Ct. 786, 792 (2003); Glaus v. Anderson, 408 F.3d 382, 388 (7th Cir. 2005). Mailed notice (am) (Entered: 05/18/2007)" @default.
