- ilnd;;1:03-cv-01740_de54 RegisterActionDescriptionText "MINUTE ORDER of 2/18/04 by Hon. Joan B. Gottschall : Plaintiff's motion to compel is granted [42-1]. Defendants are directed to respond to any outstanding discovery requests forthwith; Defendants are further directed to file a notice of compliance within twenty-one days verifying that they have done so. Plaintiff's motion to quash subpoena duce tecums is denied [43-1]. Defendants are entitled to review plaintiff's master file and medical records. Under the circumstances of this case, where Plaintiff is claiming that alleged mistreatment violated his constitutional rights, those records may be relevant and/or calculated to lead to the discovery of admissible evidence. In addition, Plaintiff is mistaken that he has no right to review that information himself. Plaintiff should contact his counselor to ascertain proper procdures for gaining access to those inmate files and medical records that are open to inspection. Finally, Plaintiff's motion to depose defendants is denied [41-1]. The motion appears to be moot, as defendants have been directed to respond to outstanding discovery requests. In any event, concerns of prison security and administration weigh against allowing Plaintiff to take oral depositions; moreover, Plaintiff would have to pay for a court reporter. As a practical matter, Plaintiff is limited to written discovery. Mailed notice (ntf) (Entered: 02/19/2004)" @default.
