Kennelly: Plaintiff 3E78F64 has filed a pro se complaint against his former employer Apple Illinois LLC under Title VII of the Civil Rights Act of 1964, alleging that the employer discriminated against him in November 2002 based on his race. Plaintiff's complaint discloses, however, that he has not filed an administrative charge of discrimination with the Equal Employment Opportunity Commission (EEOC). Filing of such a charge and thereafter obtaining a right-to-sue letter from the EEOC is a prerequisite to filing suit in federal court. See Alexander v. Gardner-Denver Co., 415 U.S. 36, 47 (1974). The court therefore dismisses plaintiff's action for failure to exhaust administrative remedies. If plaintiff wishes to pursue his claim, he should promptly file charges with the EEOC; the law imposes time limits on the filing of such charges. See generally 42 USC sec. 2000e-5(e).
