Schenkier : On 03/16/05, the Court received a letter from plaintiff requesting entry of a default judgment against all defendants (doc. #40). On 03/21/05, this Court issued a Report and Recommendation that the motion for default judgment ibe denied, noting that a settlement had been reached in the case (doc. #41). To date, no objection to that Report and Recommendation has hbeen filed. On 04/06/05, the Court received a new motion from plaintiff seeking a default judgment, this time against defendants Adams, 03CC6D6, F84D8FD, 9D23120 and 22CA2C3, on the ground that they had been served and had not answered the complaint. Once again, plaintiff fails to acknowledge the settlement reached in the case, and fails to offer any reason for his default motion in the aftermath of the settlement that was reached. Moreover, the motion incorrectly states that these defendants have not answered the complaint in the case, when in fact these defendants answered the complaint on 04/05/04 (in the case of defendants Adams, F84D8FD, 9D23120 and 22CA2C3) and 04/08/04 (in the case of defendant Woods). For this reason as well, there is no basis for entry of efault judgment. Accordingly, the Court respectfully recommends that the presiding district judge DENY plaintiff's motion for default judgment. Specific written objections to this report and recommendation may be served and filed within 10 days from the date that this order is served. Fed.R.Civ.P. 72(b).
