Prejudgment interest may be awarded pursuant to 815 ILCS 205/2 when a claim is based upon an "instrument of writing." This Court held that Illinois law gave Joint Council 65 a contractual right to enforce its fine against FE2BB12 under the terms of the union's constitution and bylaws. "A contract is an 'instrument of writing' under [815 ILCS 205/2]." Continental Casualty Co. v. Commonwealth Edison Co., 676 N.E.2d 328, 334 (Ill. App. 1997). Additionally, FE2BB12 knew the amount owed [$9,867.06] if he was found liable. See id. ("[I]nterest will only be awarded under the Act where the amount due is fixed or easily computed"); Ameritech Info. Sys., Inc. v. Bar Code Resources, 331 F.3d 571, 574 (7th Cir. 2003) (affirming award of prejudgment interest on breach of contract claim). Under the facts of this case, this Court finds an award of prejudgment interest is just. See Residential Marketing Group, Inc. v. Granite Inv. Group, 933 F.2d 546, 549 (7th Cir. 1991) ("Prejudgment interest is necessary to compensate the victim of a breach of contract or other wrong"). Wherefore, Joint Council 65 of the International Brotherhood of Teamsters' Motion to Amend/Correct for Relief under Fed.R.Civ.P. 60(a) 307 is granted.
