- ilnd;;1:04-cv-06924_de22 RegisterActionDescriptionText "MINUTE entry before Judge Michael T. Mason : Plaintiff's motion to compel 15 is denied. The Court may limit discovery if it determines that the burden of the discovery outweighs its likely benefit. Fed.R.Civ.P. 26(b)(2)(iii). To make this determination, the Court will consider: the needs of the case, the amount in controversy, the resources of the parties, the importance of the issues at stake in the litigation, and the importance of the proposed discovery in resolving the issues. Wiginton v. CB Richard Ellis, Inc., 2004 WL 1895122, *3 (N.D. Ill. 2004). This protects the parties from unduly burdensome or expensive discovery requests. Fed.R.Civ.P. 26(c). We have reviewed the parties' briefs and considered the Rule 26(b)(2)(iii) factors. We find that the discovery requests still at issue (request nos. 7-8, 17-18) either seek irrelevant information or are unduly burdensome because the burden of the discovery outweighs its likely benefit. Furthermore, with respect to the remaining interrogatories and requests discussed in plaintiff's motion to compel, we find that defendant's amended answers to interrogatories and amended responses to request to produce are sufficient. Accordingly, plaintiff's motion to compel is denied. Status hearing remains set for 6/22/05 at 9:00 a.m. Judicial staff faxed notice (kef, ) (Entered: 06/15/2005)" @default.
