ECF7035 failed to appear for today's hearing on the government's motion to show cause why supervised release should not be revoked. Former defense counsel, Mr. Rasia, has appeared today and has shared with the court his recent dealings with the defendant, which indicate to the court that the defendant is in a confused state-of-mind which reflects the apparent serious psychological problems that he has. Mr. Gutierrz appears as counsel for the defendant. There are approximately six months left on the defendant's supervised release and the court finds that nothing worthwhile in terms of the defendant's rehabilitation could be accomplished within that period of time, especially given the defendant's uncooperative attitude and the probable failure that the probation officer could expect to experience in gaining any cooperation whatever from him. The court finds that there are far better and more economical uses of the probation officer's time. Nothing useful would be accomplished by incarcerating the defendant for his violations of the conditions of his supervised release, as is indicated by the fact that the 16-month sentence previously imposed by Judge Manning did no good whatsoever. The court finds the defendant has violated his supervised release by failing to stay in contact with the probation officer, by misrepresenting his employment status, by refusing to attend mental health counseling, and perhaps by having committed the state-crime of theft and forgery for which he is presently under the jurisdiction of the Circuit Court of Cook County. Because of these violations the court revokes the defendant's supervised release as unsatisfactory, but instead of incarcerating the defendant, instead discharges the defendant from further supervision.
