Grady: Plaintiff has filed a memorandum seeking leave to utilize expert testimony on police procedures. When the court addressed the issue at the status hearing on March 5, 2008, we had in mind the case ofThompson v. City of Chicago, 472 F.3d 444 (7th Cir. 2006), in which the Court of Appeals held that the district court did not abuse her discretion in barring expert testimony on whether a police officer used excessive force. In this case, however, plaintiff does not seek to use expert testimony about excessive force,but rather about proper homicide-investigation techniques, proper eyewitness identification procedures, and eyewitness reliability. We have reviewed the cases cited by plaintiff, and it appears that such expert testimony may be admissible. Still, we would need to conduct voir dire of the proposed expert witness(es) at the time of trial; therefore, plaintiff's request is taken under consideration, to be ruled upon at trial. At trial, plaintiff should present his non-expert witnesses before calling the experts, so that the court can better assess the admissibility of the proposed expert testimony in light of the particular facts of the case. To allow plaintiff additional time to conduct his proposed expert discovery, the previously-set discovery cutoff date of June 30, 2008 is vacated, and the new discovery cutoff date will be August 29, 2008.Mailed notice (mjc, ) (Entered: 04/28/2008)" @default.
