In the instant action, the parties have failed to file a joint jurisdictional status report, as this court ordered on March 11, 2005. A review of the complaint, however, shows that both parties' principal place of business is New York which, if true, would defeat diversity jurisdiction. Accordingly, we dismiss this action without prejudice. The parties are given two weeks, until February 7, 2006, to show that diversity jurisdiction exists, that venue is proper in this court, and that this action should be reinstated.
