This case, which involved allegations that prison officials and healthcare providers at Stateville Correctional Center provided inadequate treatment and accommodations for plaintiff's various health conditions, was dismissed with prejudice on 9/30/08 after the parties reached a settlement and reported that the terms of settlement had been fulfilled (102). A motion to alter or amend the judgment filed 10/9/08 (103) was denied on 1/6/09 (109). The pending motion was filed on 8/3/2015. A motion under Rule 60(b)(3) must be made within one year of entry of judgment. See Rule 60(c). This motion is more than five years late. Moreover, despite its title, plaintiff's motion appears to request that the Court enforce the terms of the settlement against parties that were not defendants to the original action. The Court, however, relinquished jurisdiction over this matter at the time it was dismissed with prejudice. See Lynch, Inc. v. SamataMason, Inc., 279 F.3d 487, 489-90 (7th Cir. 2002) (explaining that district court has no jurisdiction to enforce a settlement agreement in a dismissed case, "unless [the agreement] is embodied in a consent decree or some other judicial order or unless jurisdiction to enforce the agreement is retained (meaning that the suit has not been dismissed with prejudice)."). If Plaintiff believes that "the current administration" has been deliberately indifferent to his serious medical needs, he must file a new law suit. This case remains closed.
