- ilnd;;1:06-cv-01087_de9 RegisterActionDescriptionText "MINUTE entry before Judge Virginia M. Kendall : On April 3, 2006, this Court dismissed Plaintiffs' Complaint without prejudice to refile within 30 days. As explained in the Court's order, Plaintiffs have 30 days to file a new Complaint that complies with Federal Rule of Civil Procedure 8. On April 10, 2006, the Court received Plaintiffs' Notice to Deny Dismissal Without Prejudice. The Court reads this document as saying that it did not have the power to dismiss Plaintiffs' Complaint without a motion by Defendants. The Court has the power to dismiss a complaint on its own motion, or sua sponte, for failing to comply with Rule 8. See, e.g., Pinnavaria v. C-Phone Corp., 2002 WL 575699, 01-CV-50341 (N.D. Ill. 2002)(dismissing complaint sua sponte for failure to comply with Rule 8(a)). If Plaintiffs wish to continue to pursue their case, they must follow the Court's instruction in its previous order and file a new Complaint that complies with the Federal Rules of Civil Procedure. Plaintiffs do not have to pay the filing fee again in order to file their new Complaint. Mailed notice (gmr, ) (Entered: 04/13/2006)" @default.
