In response, Plaintiffs agree that their lack of criminal history is inadmissible to prove that they engaged in no bad behavior on the day in question. In other words, Plaintiffs may not introduce their lack of a prior criminal record to establish their good character on the day of the incident. Nevertheless, Plaintiffs may introduce the lack of prior jail time to establish damages. See Kakeh v. United Planning Org., Inc., 587 F.Supp.2d 125, 128-29 (D.D.C. 2008) (When a law abiding citizen with no criminal record is arrested, jailed for 12 days and 13 nights, and placed on probation for one year, that person almost certainly has to have suffered a significant emotional impact.)
