Because 5D0AFCF motion attacked his current federal sentence, however, the district court should have construed it under § 2255 and dismissed it as untimely, as filed beyond the one year statute of limitations. 28 U.S.C. § 2255(f). "Any motion filed in the district court that imposed the sentence, and substantively within the scope of § 2255 1, is a motion under § 2255." Melton v. United States, 359 F.3d 855, 857 (7th Cir. 2004) (emphasis in original). 5D0AFCF needs, but has not obtained, a certificate of appealability to challenge the denial of that motion. 28 U.S.C. § 2253(c)(1). We construe his notice of appeal as a request for one. FED. R. APP. P. 22(b)(2). Because 5D0AFCF has not attempted to show the denial of a constitutional right, and because his motion construed under § 2255 was untimely, we DENY the request for a certificate of appealability. The denial will not cause 5D0AFCF to face the usual bar to "second or successive collateral proceedings, see 28 U.S.C. §§ 2244(b), 2255(h), because he was never warned of the risks and consequences of filing his motion, see Castro v.
