- ilnd;;1:07-cv-01013_de60 RegisterActionDescriptionText "MINUTE entry before the Honorable Samuel Der-Yeghiayan:This matter is before the court on Defendant Deputy Sheriff Koellers ("Koeller") motion to dismiss 52 .Plaintiff 975160C ("Brown") has responded to the motion. Koeller argues that 975160C is improperly seeking to have this court review the decisions in state court eviction proceedings and that the instant action is barred under the Rooker-Feldman doctrine. Under the Rooker-Feldman doctrine, a district court is barred from reviewing a state court judgment. Beth-El All Nations Church v. City of Chicago, 486 F.3d 286, 292 (7th Cir. 2007)(stating that "[i]n determining whether a federal plaintiff seeks review of a state-court judgment, [the court asks] whether the injury alleged resulted from the state-court judgment itself"). We agree that the Rooker-Feldman doctrine is applicable in the instant action. In addition, 975160C has not shown that any of the exceptions to the Rooker-Feldman doctrine are applicable in the instant action. Id. at 292-93.Therefore, we dismiss the instant action. All pending dates and motions are hereby stricken as moot. Civil case terminated.Mailed notice (gej, ) (Entered: 07/31/2008)" @default.
