There is not really any point in having piecemeal motions for summary judgment in this case and I agree that plaintiffs' present motion appears to be inconsistent with their complaint. Nor have plaintiffs given any compelling reason for not completing discovery in the time proposed by defendant. Accordingly, fact discovery will close on 3/31/2009, any further motion for summary judgment shall be filed by 4/15/2009, responses to the motion and any supplemental motion for summary judgment shall be filed by 5/8/2009, any replies by 5/22/2009. Ruling will be by mail on or about 6/25/2009. This schedule does require that parties appear for their depositions in a timely fashion. Accordingly, if defendant does not agree to provide its 30(b)(6)witness for deposition by 2/20/2009, it shall file a response by that date and this schedule will be vacated. Plaintiffs shall also appear for their depositions. Plaintiffs' motion to amend the complaint 55 is denied. Ordinarily, of course, leave to amend a complaint shall be freely given. But, contrary to plaintiffs' representations in their motion and memoranda in support, the proposed amendment in this case would directly contradict a statement in their initial pleading, namely that they had given written consent to defendant to obtain credit information about them. There may be other issues regarding the scope of the consent, but plaintiffs are bound by admissions in pleadings. The remaining alleged purposes in amending this complaint are unnecessary. The class allegations have been dropped at the request of plaintiffs, and it is unnecessary at this point to amend a complaint to note that one party has settled.
