Cox: Now before the Court is defendants' motion for additional discovery 77 , requesting leave to take Stephen Sorgatz's deposition. Mr. Sorgatz is the biological son of the deceased and, in May 2009, he executed a disclaimer of his interest in the wrongful death claim brought by the estate. Defendants now argue that it is necessary to take his deposition so that they are able to support certain defenses to the action. But what is apparent from the motion is that defendants simply question why no disclaimer was executed by Mr. Sorgatz earlier, as Mr. Sorgatz knew about the estate proceedings three years prior to the disclaimer. There is no reason, beyond this question, that the Court can find to justify defendants' request to take this deposition. The problem is, the mere ephemeral possibility that there was some fraudulent or questionable reason for the timing of the disclaimer does not warrant the taking of Mr. Sorgatz's deposition, at this stage in the litigation. This is especially true given Judge Manning's recent ruling, finding that the disclaimer should be considered and is properly included in the complaint. Because we find that there is nothing in defendants' motion to explain how this additional discovery would be relevant, defendants' motion 77 is denied.
