He filed a notice of appeal and an application for a certificate of appealability, but this court denied his request. Cox v. Gilson, No. 08-2988 (7th Cir. Dec. 12, 2008). Before this court is Cox's appeal from the denial of his motion for reconsideration under Rule 60(b). Cox asserts in the motion that the district court should have reached the merits of his original petition rather than dismissing it as untimely. The district court denied the motion, explaining that Cox had not established that the earlier judgment is void. The district court properly denied the motion. Cox has not offered a viable excuse for his late petition, much less a reason to vacate the decision dismissing it. Accordingly, the implied request for a certificate of appealability is Denied.
