While Plaintiffs appear confident that they would designate one or all of these individuals as their 30(b)(6) deponents, Defendants should have the opportunity after deposing certain key witnesses to make their own assessment regarding what areas they need to cover under Rule 30(b)(6). Defendants have advised Plaintiffs that they may not even need any Rule 30(b)(6) depositions depending on what they are able to discover from these three individuals. If Rule 30(b)(6) depositions become necessary at a later time, the parties are encouraged to evaluate whether they could agree to designate certain deposition testimony already provided by these individuals as Rule 30(b)(6) testimony, rather than engaging in repetitive depositions.
