Grady:In our order of May 13, 2009, we directed petitioner to confer with respondent regarding the terms if an injunctive order that would conform with our memorandum opinion and to submit a proposed order to this court. Petitioner has submitted a proposed order, and respondent objects to the provision requiring it to withdraw instructions that LPN's are required to discipline CNA's or to make room assignments to CNA's. This provision conforms with our opinion, but respondent contends that is "creates an impossibility which could give rise to contempt proceedings before this court for violating" the court's order. (Respondent's Objection at 2.) Respondent explains that the Illinois Administrative Code provision setting forth the minimum standards for nursing homes requires that "(t)here shall be a licensed nurse designated as being in charge if nursing services on all shifts when either the director of nursing or assistant director of nursing are on duty." Ill.Admin.Code tit.77, 300.1240. Respondent's objection is overruled because this provision of state law does not require that LPN's discipline CNA's or make room assignments to CNA's as a general rule; therefore, respondent would not be violating state law by complying with out order.
