- ilnd;;1:08-cv-03218_de38 RegisterActionDescriptionText "MINUTE entry before the Honorable Amy J. St. Eve: Plaintiff has not stated diversity jurisdiction in this matter. "It is axiomatic that a federal court must assure itself that it possesses jurisdiction over the subject matter of an action before it can proceed to take any action respecting the merits of the action." Cook v. Winfrey, 141 F.3d 322, 325 (7th Cir. 1998) (quoting Steel C. v. Citizens for a Better Environment, 523 U.S. 83, 94 (1998)). This requirement is "inflexible and without exception." Id. Plaintiff's Complaint alleges that Plaintiff "resides" in Illinois. (R. 1-1, at 11.) Allegations of residence are insufficient to establish diversity jurisdiction, and it is well settled that the Court must dismiss suits in which the complaint alleges residence, but not citizenship. See Held v. Held, 137 F.3d 998, 1000 (7th Cir. 1998); see also Adams v. Catrambone, 359 F.3d 858, 861 n.3 (7th Cir. 2004). As such, the Court orders Plaintiff to submit by 9/2/08, a supplemental statement of jurisdiction setting forth the grounds upon which they believe diversity jurisdiction is proper. Mailed notice (kef, ) (Entered: 08/26/2008)" @default.
