Having reviewed Plaintiff's Motion and considering the arguments made in open court, the court finds that the motion is Granted in part and Denied in part. The Court grants Plaintiff's motion to compel Defendant to produce his flash drives. The Plaintiff shall have access to the flash drives and/or flash drive files by noon, September 10, 2008. The Defendant shall have an opportunity before that time to review the data for privilege. As to the visa documents, this Court has already determined that the relevancy of such documents is very limited in light of the potentially damaging effect of potential legal consequences to the visa applicant [ 89]. However, in the instant motion, Plaintiff argued that the documents would be relevant for purposes of discovery to show when Defendant Neergheen began his employment with Datamonitor and whether he possibly breached his duty of loyalty to Mintel by working for both Mintel and Datamonitor. In light of the competing interests, this Court agreed to an in camera review and the Defendant was ordered to provide Defendant's immigration visa application to Chambers for an in camera review by 5:00 p.m. today. The Court having undertaken an in camera review of documents submitted by the Defendant finds that the information will not lead to the discovery of potentially relevant evidence. Based on the in camera review, the Court finds that the visa application made by Defendant Neergheen post-dated his last day of employment with Mintel which was April 30, 2008. Therefore, based on Plaintiff's relevancy argument the disclosure of the visa documents would not lead to relevant evidence. Defendant shall pick up the in camera submission on September 11, 2008. Finally, Plaintiff's Motion styled Plaintiff's Motion for Leave to File Plaintiff's Memorandum of Law in Support of its Motion to Exclude Testimony of Datamonitor and its 30(b)(6) Witness Jeffrey Howard and for Other Sanctions 75 is granted. Plaintiff may file the proper motion and memorandum of law by 10:00 a.m. on Wednesday, September 10, 2008. The briefing schedule for this Motion to Exclude is set as follows: Defendant's Response is due by 4:30 p.m. on Wednesday, September 10, 2008; Plaintiff's Reply, if any, is due by 4:30 on Thursday, September 11, 2008.
