As the Court discussed in its January 10, 2013 ruling, because the police officers did not know that an individual had approached Mr. Masud before he called the police at the time they arrested Plaintiff, this evidence has little, if any, probative value. See Gonzalez v. City of Elgin, 578 F.3d 526, 537 (7th Cir. 2009). Moreover, as discussed in open court on February 4, 2013 and in the Court's January 10 ruling, what little probative value this evidence has is substantially outweighed by unfair prejudice. See Fed.R.Evid. 403. Similarly, evidence that Mr. Masud lived in a gang neighborhood is also prejudicial, especially because there is no evidence in the record that Mr. Masud or Plaintiff were affiliated with a gang.
