Those categories may generally be described as document requests and interrogatories relating to: 1) the information on the automatic defibulator chip, 2) who, if anyone, was responsible for taking Mr. Willie Winters to the hospital on the particular day he appeared in State Court in 2007, 3) the December 14 sick call issue; and 4) the Nurse 05835DB issue. The defendant is ordered to answer by 10/5/2010 all outstanding interrogatories that relate to those 4 categories and to comply with all outstanding document requests that relate to those four categories. Document production must be linked to the particular request. Within the next 7 days defendant is to designate one or more 30(b)(6) witnesses who may be required to testify about these four open issues should counsel for the plaintiff conclude that that is necessary after further review of the responses to the open discovery requests pertaining to the four issues. All further discovery disputes will be considered against the backdrop of Judge Easterbrook's panel opinion in Rickles v. City of South Bend, Indiana, 33F.3d 785.786 (7th Cir. 1994): "'The great operative principle of Rule 37(a)(4) is that the loser pays.' Charles Alan Wright & Arthur R. Miller, 8 Federal Practice and Procedure Section 2288 at 787 (1970). Fee shifting, when the judge must rule on discovery disputes, encourages their voluntary resolution and curtails the ability of litigants to use the legal process to heap detriments on adversaries without regard to the merits of the claim."
