The proposed protective order defines "Confidential" information in a circular fashion as "confidential personal or business information of a non-public nature" that either party designates as "Confidential." (Agreed Protective Order 2.) As drafted, the proposed order is overbroad. See Citizens First Nat'l Bank v. Cincinnati Ins. Co., 178 F.3d 943, 946 (7th Cir. 1999). By June 22, 2011, the parties should submit to the court a revised proposed order that is more specifically tailored to protect "legitimately confidential information." See id.
