- ilnd;;1:09-cv-08035_de49 RegisterActionDescriptionText "MINUTE entry before Honorable Sharon Johnson Coleman: For the foregoing reasons, the court finds that petitioner Darryl Sutton's Fourth Amendment claims were properly presented by his appellate counsel, but improperly rejected by the courts of Illinois. His petition for a writ of habeas corpus is accordingly granted. The parties' pleadings indicate that Sutton is still lawfully in the custody of the Illinois Department of Corrections as a result of proceedings not at issue here. 28 U.S.C. § 2243 grants this court discretion to dispose of a habeas application as law and justice require, and that disposition need not order an immediate release from custody even if the petition is granted. Sutton v. Lash, 576 F.2d 738, 745-46 (7th Cir. 1978); U.S. ex rel. Westbrook v. Randolph, 259 F.2d 215, 217-18 (7th Cir. 1958). Issuance of the writ is stayed until further order of court pending Suttons demonstration that he is no longer lawfully in the custody of the State as the result of any other charge, and further pending the States right to commence proceedings to retry him on the present charges within 120 days of any such showing. Enter Order. Civil case terminated. Mailed notice (rth, ) (Entered: 10/18/2013)" @default.
