- ilnd;;1:10-cv-01481_de6 RegisterActionDescriptionText "MINUTE entry before Honorable Blanche M. Manning: Defendant AF84436 filed two motions for reconsideration, [5-1] on March 29, 2011, and [6-1] on March 30, 2011, but did so without a notice of presentment as required under Local Rule 5.3(b). As a result, the court only learned about the motions during a recent review of the court's docket. In the motions, Mr. AF84436 asks the court to reconsider his arguments as a motion for writ of coram nobis under 28 U.S.C. 1651, as he had originally requested, rather than to correct or vacate his sentence under 28 U.S.C. 2255, as the court had recharacterized the motion. However, a writ of coram nobis is for a defendant who has completed his sentence. See United States v. Velasquez, No. 84 CR 646, 1995 WL 608560, at *1 (N.D. Ill. Oct. 13, 1995). Mr. AF84436 remains in custody and, therefore, his motion is one to correct or vacate his sentence under 28 U.S.C. 2255. Id. For that reason, his motions for reconsideration [5-1] and [6-1] are denied.Mailed notice (rth, ) (Entered: 11/22/2011)" @default.
