- ilnd;;1:10-cv-06835_de3 RegisterActionDescriptionText "MINUTE entry before Honorable John F. Grady:Plaintiffs, the Moorish Science Temple of America and Zayyaid Imad Muziah El, have filed a document titled "Emergency Transfer Notice" that appears to be an attempt to remove (from the Circuit Court of Cook County) an action for forcible entry and detainer that was filed against Muziah El by Wells Fargo Bank. Because plaintiffs seek leave to proceed in forma pauperis, we are required to consider, among other things, whether the complaint states a claim upon which relief may be granted. See 28 U.S.C. § 1915(e)(2)(B)(ii). Although plaintiffs' filings are confusing and include frivolous sovereign-citizen arguments, we candiscern that they take issue with an order for possession of the premises at 6723 South Justine in Chicago, Illinois that was entered by the state court on August 13, 2010. Mr. Muziah El states that he is "left with no other recourse" than to seek review by this court and seeks a restraining order to prevent his eviction. The Rooker-Feldman doctrine, however, precludes this court from hearing cases brought by those who lose in state court "complaining of injuries caused by state-court judgments rendered before the district court proceedings commenced and inviting district court review and rejection of those judgments." Exxon Mobil Corp. v. Saudi Basic Indus. Corp., 544 U.S. 280, 284 (2005). Because the Rooker-Feldman doctrine applies, we have no jurisdiction to hear plaintiffs' claims. The application to proceed in forma pauperis is denied, and the case is dismissed with prejudice. Mailed notice. (Entered: 10/28/2010)" @default.
