For the reasons set forth in Plaintiff's letter to Defendant's counsel attached as Exhibit 3 to Defendant's Motion [265-3] and discussed in Defendant's Motion 265 at pages 4 to 6, it is reasonable to believe that Guresci has information that is discoverable within the meaning of Federal Rule of Civil Procedure 26(b)(1). Defendant's objections to the deposition have more to do with the weight of Guresci's anticipated testimony and to his credibility than they do with the relevance of that testimony. In addition, the briefing schedule set on 6/10/13 for Defendant's Motion 273 is stricken. The Court assumes that Plaintiff's argument for taking Blaases deposition remains as set forth in her Motion to Compel Blaase to sit for her deposition filed on 3/21/13 as an exhibit to Plaintiff's Motion for Leave to File that Motion [172-1]. Although the District Judge denied Plaintiff leave to file her Motion to Compel Blaase's deposition in an order entered on 3/27/13 176 , the Court will consider Plaintiff's arguments in that proposed Motion to Compel [172-1] as if they were set forth in opposition to Defendant's current Motion for a Protective Order 265 regarding the Blaase deposition. Plaintiff laid out in her Motion to Compel [172-1] the reasons she wanted to take Blaase's deposition. There is, therefore, no need for Plaintiff to file a brief in opposition to Defendant's Motion 265 with respect to the Blaase deposition. The hearing on Defendant's Motion for Protective Order as to Blaise's deposition, set for 6/27/13 at 11:00 a.m., will stand unless the Court rules on the remaining portion of Defendant's Motion regarding the Blaase deposition prior to that date via the CM/ECF system.
