Defendant asserts that plaintiffs have failed to adequately plead their complaint for relief under section 502(a)(1)(B) of the Employee Retirement Security Act of 1974 (ERISA), 29 U.S.C. §1132(a)(1)(B), because the Amended Complaint does not provide defendant with notice of the existence of an ERISA plan, the relevant terms of the plan giving rise to the benefits to which plaintiffs are claiming entitlement, or the manner in which defendant has breached its obligations to plaintiffs under the plan. In order to survive a motion to dismiss, the plaintiff need not plead particularized facts, but the factual allegations in the complaint must be enough to raise the right to relief above the speculative level. Fed. R. Civ. P. 8(a); Bell Atlantic Corp. v. Twombly, 550 U.S. 544, 569 n.14 (2007); Tamayo v. Blagojevich, 526 F.3d 1074, 1081 (7th Cir. 2008). A review of the Amended Complaint reveals bare claims that defendant provided staff employee pension plans in general and that defendant failed to notify plaintiffs of the terms of the pension plans. (Dkt. 15 at 14, 18.) While detailed factual allegations are not required, plaintiffs amended complaint lacks sufficient allegations for this Court to discern whether a plan exists and whether it might cover plaintiffs in this case.
