Cox: As a result of the plaintiff's attack in open court of the defendant officer, the Clerk of Court is directed that if the jury trial transcript of the proceedings held 2/11/13 through 2/14/13, in the above-captioned matter is filed, that the portion of the transcript that includes juror names be sealed. We determine that the potential threat to juror safety outweighs the right to have public access to jurors names. The violent nature of the plaintiff's actions after learning of the verdict, coupled with the jurors' expressed concern for their safety, supports our finding that the jury warrants protection. See U.S. v. Edwards, 823 F.2d 111, 120 (5th Cir. 1987)(in the criminal context, redacting portions of the trial transcript, holding that the jurors were entitled to protection even after completing their duties); see also U.S. v. Thai, 29 F.3d 785, 801 (2nd Cir. 1994) (discussing use of anonymous jury in a criminal context, concluding that if the court supports its decision with evidence that the jury needs protection, and protects the rights of the defendant, such is reviewed only for abuse of discretion).
