- ilnd;;1:11-cv-02801_de91 RegisterActionDescriptionText "MINUTE entry before Honorable Amy J. St. Eve: In Defendants' motion in limine #8, Defendants move to bar any reference to punishing or sending a message to the City of Chicago because as a matter of law Plaintiff cannot recover any punitive damages from the City. See 745 ILCS 10/2-102. Nevertheless, Plaintiff is seeking punitive damages against the individual Defendant Officers. Under similar circumstances, courts in this district have granted the City of Chicago's motion in limine barring plaintiffs from arguing that the jury should "send a message" to the City, but allowing plaintiffs to make this argument about the Defendant officers. See, e.g., Betts v. City of Chicago, 784 F.Supp.2d 1020, 1033 (N.D. Ill. 2011); Bruce v. City of Chicago, 09 C 4837, 2011 WL 3471074, at *6 (N.D. Ill. July 29, 2011). Based on the Bruce and Betts courts' reasoning, the Court adopts this approach and grants in part and denies in part Defendants' in limine motion #8 65 .Mailed notice (kef, ) (Entered: 11/07/2012)" @default.
