However, the complaint fails to properly allege the parties' citizenships. The plaintiff, as special administrator of the estate of Franklin Housen, is considered to be a citizen of the state of the decedent. 28 U.S.C. § 1332(c)(2). The complaint fails to mention Mr. Housen's state of citizenship at the time of his death. Moreover, it fails to set forth the principal places of business of the three defendant corporations, and it simply alleges defendant 74BD754 "residence," which is not synonymous with citizenship. Plaintiff will be given until September 14, 2011 to file an amended complaint that properly alleges the parties' citizenships. We note, however, that because defendant Illinois Central Railroad Company, Inc. is alleged to be an Illinois corporation and therefore a citizen of Illinois, if Mr. Housen had been a citizen of Illinois, diversity jurisdiction would be destroyed and we would have to dismiss the case.
