- ilnd;;1:12-cv-00413_de21 RegisterActionDescriptionText "MINUTE entry before Honorable Elaine E. Bucklo: Defendants Lia Sophia and C2D3CB3 have filed a motion to dismiss 15 pursuant to Federal Rule of Civil Procedure 12(b)(6). Defendant Lia Sophia seeks to dismiss plaintiffs failure to accommodate claim and defendant C2D3CB3 seeks to dismiss the entire complaint. The motion is granted. The scope of plaintiffs complaint is limited by the nature of the charges she filed with the EEOC. Peters v. Renaissance Hotel Operating Co., 307 F.3d 535, 550 (7th Cir. 2002); Rush v. McDonalds Corp., 966 F.2d 1104, 1110 (7th Cir. 1992). The charge filed with the EEOC alleged harassment and discharge but did not allege a failure to accommodate. Because a reasonable accommodation claim is not like or reasonable related to plaintiffs harassment and discharge claims, plaintiff cannot rely on her original charge as a basis for her failure to reasonably accommodate claim. That claim is therefore dismissed. Defendant C2D3CB3 contends that the entire complaint should be dismissed with respect to him for failure to state a claim. As defendants point out, neither the ADEA nor the ADA permits claims against individuals. For this reason, the entire complaint is dismissed as to C2D3CB3.
