Plaintiff has identified 14 people named in Defendant's Rule 26(a) disclosures and he "proposes to take depositions of most of [those 14 people]." Plaintiff's Proposed Deposition Plan 74 at p. 1. That is almost verbatim the statement Plaintiff made in Section II(B)(iii) of the Joint Discovery Plan the parties filed on 3/31/14 72 . In that "Joint Plan," the parties disagreed about how much time they would need to complete discovery because, in part, they did not agree how many depositions Plaintiff should be permitted to take. That disagreement, in turn, caused the Court to enter its order of 4/1/14 in which it required Plaintiff to submit "a proposed deposition plan that identifies the individuals he wishes to depose and explains why each of the persons identified should be deposed." 71 The Court entered that order so it could decide whether it should expand the number of depositions Plaintiff would be allowed to take beyond the presumptive limit set in Federal Rule of Civil Procedure 30(a)(2)(A)(i). But Plaintiff's Proposed Deposition Plan 74 provides the Court with no more information than it had before it entered its order on 4/1/14. 71 Accordingly, Plaintiff will be limited to the 10 depositions permitted without leave of court by Federal Rule of Civil Procedure 30(a)(2)(A)(i). If Plaintiff wants to take more than 10 depositions in this case, he shall file a motion for leave to do so that specifically identifies the additional depositions he wants to take and why he wants to take them. Nothing in this order is intended to prevent Defendant from filing a motion for a protective order with respect to any particular deposition noticed by Plaintiff if it believes in good faith that a deposition should not be taken even if Plaintiff is within the 10 deposition limit. In light of this order, Defendant need not file a response to Plaintiff's Proposed Deposition Plan.
