Defendant NFI states that it does not intend to depose Plaintiff's treating physicians identified in his Rule 26(a)(2)(C) disclosures, all of whom reside out of state, because of the expense of doing so. Plaintiff states that he intends to memorialize these witnesses' trial testimony via depositions taken after Defendant discloses its own experts. Defendant states that it does not want to disclose its own expert witnesses or produce their reports until Plaintiff deposes his own treating physicians to memorialize their trial testimony. Plaintiff objects to that procedure. Plaintiff submits that Defendant now can depose Plaintiff's Rule 26(a)(2)(C) experts if it desires to do so. If Defendant chooses not to do so, however, then Plaintiff argues Defendant should be required to disclose its experts without the benefit of them hearing Plaintiff's experts' trial testimony. The Court continued the status hearing to 2/19/14 at 10:45 a.m. to discuss this matter further before it sets a date for Defendant to disclose its own Rule 26(a)(2) expert(s). Having reflected on the issues raised during this morning's status hearing, the Court is inclined to require Defendant to make its Rule 26(a)(2) disclosures and then to allow either party that wants to take expert depositions to do so thereafter.
