The Court held part of the hearing on a ex-parte, under-seal basis with the defendant and Mr. Francis Baumgart, to ensure that the defendant could speak freely about the attorney-client relationship, to provide the defendant with enough facts to make an informed decision, and so that the Court could ask the defendant more specific questions about his view of Mr. Baumgart's representation of the defendant. On the public record, the Court informed the defendant of the decision by the Panel Advisory Selection Committee's decision to terminate Mr. Baumgart's participation on the CJA Panel due to the Committee's concerns over his qualifications. Notwithstanding the information, the defendant expressed an affirmative desire to have Mr. Baumgart continue as his attorney. The Court also notified the defendant that if he wanted a different attorney, the Court would grant the request and would postpone the trial for the new attorney to learn the case. The defendant still wanted Mr. Baumgart to continue on the case. For the reasons stated in open court and during the ex-parte hearing, the motion to withdraw is denied. The Court finds exceptional circumstances (including the relationship between the defendant and Mr. Baumgart, and for the continuity of counsel) to permit Mr. Baumgart to remain as counsel on behalf of the defendant even though Mr. Baumgart is no longer on the CJA Panel. The Court informed the defendant that if he wanted to change his mind, he can inform Mr. Baumgart and also need simply call, by 4:00 p.m. on 04/10/2014, the courtroom deputy for a hearing. With regard to the trial, if the defense wishes to file a motion on requiring Walter Blackman to appear for trial to assert the right against self-incrimination, the motion is due by 04/23/2014 at 4 p.m. That same deadline applies to any request by the defense to have Mr. Blackman brought for the 04/25/2014 hearing; the defense absolutely must alert both the government and counsel for Mr. Blackman if he makes the request to bring Mr. Blackman over for the hearing.
