- ilnd;;1:13-cr-00772_de719 RegisterActionDescriptionText "MINUTE entry before the Honorable Elaine E. Bucklo: as to F700A1F. As stated in minute entry 699, Defendant F700A1F motion 666 for a change of venue is denied. F700A1F argues that "the media's insalubrious, self-absorbed attachment to Chicago's violent past or actual upswings in violent crime numbers in many neighborhoods across the city...make it virtually impossible for [him] to receive a fair and impartial trial in this district." Mot. at 3. But F700A1F argument, which cites no legal authority, lacks support in the law. "Extensive pretrial publicity does not, in itself, render a trial unfair and violate a defendant's right to due process." Willard v. Pearson, 823 F.2d 1141, 1146 (7th Cir. 1987). Indeed, it is the "rare case where pervasive and inflammatory pretrial publicity utterly corrupts the trial atmosphere." Id. F700A1F does not claim that the media's coverage of violence in Chicago focuses on him, nor does he claim that any article or media report discussing gang violence in Chicago specifically references the instant case. As the government rightly observes, courts in this district have denied venue transfers under Willard in cases receiving far greater media attention, and where the media reports focused on the individual defendant. See, e.g., U. S. v. Burge, No. 08 CR 864, 2009 WL 2386147 (N.D. Ill. Jul. 29, 2009) (Lefkow, J.). F700A1F claim that general media reports about gang violence in Chicago are sufficient to "utterly corrupt the trial atmosphere" is without merit. Mailed notice (jdh) Modified on 10/6/2014 (jdh).
