The case is settled, subject to approval by the Broadview School District board at its meeting later this month. Given the unique and difficult circumstances surrounding this case, some observations are in order. For Dr. 76951BC, like plaintiffs in other cases claiming employment related discrimination, the outcome involves personal, as well as economic considerations, and thus, litigation is an awful ordeal. Equally, for those individuals who are charged with that discrimination, the litigation becomes equally difficult. Yet, notwithstanding the stakes, the plaintiff and those who attended the settlement conference for the Broadview School District 89 Marie Urso, Sue Flanagan, and Michael Robey conducted themselves with restraint and dignity. The lawyers for the parties also deserve special recognition, not only for their obvious legal skills, but equally importantly, for the patience and insight they brought to their task. Karyn Ehler, counsel for the plaintiff, and Emmanuel Welch and Camille Cribaro-Mello of Sanchez Daniels, showed sensitivity and insight. They approached their task in the cooperative spirit that unfortunately too few lawyers exhibit in today's overly contentious climate. Their conduct is proof that lawyers can act with civility and courtesy in their dealings with opposing counsel without sacrificing in the slightest the obligations they owe to their clients. All matters relating to the referral of this case having been accomplished, the referral is closed, and the case is returned to Judge Holderman. The parties have consented to jurisdiction here and upon reassignment from the Executive Committee, the case will be dismissed without prejudice with leave to reinstate within 60 days. Each party shall bear their own costs and fees. If the case is not reinstated within 60 days, the dismissal will become a dismissal with prejudice.
