At bottom, it appears really to be a motion for early discovery, which would be governed by Federal Rule of Civil Procedure 26(d)(1). One way to handle such a request would be "by stipulation," Fed. R. Civ. P. 26(d)(1), but the motion does not appear to state whether defense counsel asked Plaintiff's counsel to agree to the request. The absence of that conferral would be inconsistent with both Rule 37(a)(1)'s conferral requirement as well as this Court's Case Management Procedures (at the Motion Practice link on Judge Chang's web page). And setting aside the request concerning clothing, is there a good reason to believe that Plaintiffs will be disposing of job applications before discovery starts in the normal course? (Maybe that's why Personnel Staffing mentioned the other two cases filed by Plaintiffs, but that does not seem likely.)
