On March 12, 2014, Plaintiff 156BC85 (156BC85) filed her complaint in the instant action. 156BC85 states in her complaint that this court has subject matter jurisdiction because "this is a civil action arising under the Constitution, laws or treaties of the United States," and that this court has supplemental jurisdiction over state claims, which suggests that 156BC85 is asserting that there is federal question subject matter jurisdiction in this case, and 156BC85 has also improperly alleged diversity subject matter jurisdiction. (Compl. Par. 4-5). However, 156BC85 fails to allege facts that would plausibly suggest a federal claim or proper diversity. 156BC85 indicates that she is bringing claims "for Unlawful Clouding of Title, Interference with Quiet Enjoyment of Title, Fraud, Deceptive Practices, Conspiracy, Unjust Enrichment, Intentional Infliction of EmotionalDistress and Income Tax Fraud." (Compl. 1). Aside from violation of the federal tax laws, allsuch causes of action would be state causes of action, and as to any alleged tax violation, Grayerhas not shown standing to bring any such claim against Defendants. 156BC85 states in hercomplaint that she obtained a mortgage of a property, that she "fell in arrears in payments about August 2010," and that a foreclosure action was completed on the property. (Compl. Par. 12). 156BC85 indicates dissatisfaction with how the foreclosure action proceeded and in regard to a Release of Mortgage. 156BC85 claims that Defendants "took very deliberate and precise steps to further an illegal foreclosure action and obtain a Judgement for Foreclosure and Sale." (Compl. Par. 42). 156BC85 fails to allege any facts that suggest a federal cause of action. Therefore, the instant action is dismissed for lack of jurisdiction.
