No. 4 ). Under the in forma pauperis statute, 28 U.S.C. § 1915, Plaintiff may proceed in forma pauperis if he cannot pay the required court fees and costs. See 28 U.S.C. § 1915(a)(1). "Although he must show that he cannot simultaneously pay court costs and provide for life's necessities, he 'need not be absolutely destitute in order to enjoy the benefit of § 1915.' Garth-Richardson v. Univ. of Ill. at Chi., No. 03 C 5406, 2004 WL 726135, at *1 (N.D. Ill. Apr. 1, 2004) (quoting Zaun v. Dobbin, 628 F.2d 990, 992 (7th Cir.1980)). Although Plaintiff himself reports no income since 2010, his wife is employed and receives a monthly salary of $3,638.00, which the Court finds does not satisfy the standard for indigency. See Akkaraju v. Ashcroft, No. 88 C 4834, 2003 WL 22232969, at *1 (N.D. Ill. Sept. 26, 2003) ("In evaluating the funds available to in forma pauperis movants, courts may consider the income or resources of interested persons, such as spouses and parents."); see also Fridman v. City of New York, 195 F. Supp. 2d 534, 537 (S.D.N.Y. 2002) ("In assessing an application to proceed in forma pauperis, a court may consider the resources that the applicant has or 'can get' from those who ordinarily provide the applicant with the 'necessities of life,' such as 'from a spouse, parent, adult sibling or other next friend.'). Plaintiff's Motion for Leave to Proceed In Forma Pauperis [Doc. No. 4] is therefore denied, and Plaintiff must pay the full filing fee of $400.00.
