- ilnd;;1:14-cv-05482_de65 RegisterActionDescriptionText "MINUTE entry before the Honorable Edmond E. Chang: Plaintiff's unopposed extension motion 62 on Rule 16(b) deadline is granted in part and denied in part. The stated reason for the proposed extension to 03/25/2015 is that it would be depositions that would reveal any needed amendments or new parties. But written discovery responses often prompt amendments to pleadings or addition of parties, and the Court sets Rule 16(b) deadlines with that in mind (which is why the Court sets a deadline by which the first set of written discovery requests must be issued), and also with the fact discovery deadline in mind. Setting a Rule 16(b) deadline three weeks before the close of fact discovery is very likely to require an extension of the deadline, especially if the amendment is to add parties, and thus a late deadline like that should be avoided to prompt parties to move cases along. See Alioto v. Town of Lisbon, 651 F.3d 715, 719-20 (7th Cir. 2011) (explaining purpose of Rule 16(b) deadline is to prevent delay). The deadline is extended to 02/13/2015. Of course, if there is good cause to amend pleadings or add parties after the deadline, then leave to amend will be granted anyway. Emailed notice (slb, ) (Entered: 01/23/2015)" @default.
