The parties have reached a settlement, the material terms of which were placed on the record. One of the terms of the agreement is that the parties will execute a written settlement agreement containing the material terms articulated on the record today. However, they have agreed that contract formation occurred today, that there is a binding settlement agreement today and that the ultimate execution of the contemplated written agreement is not a precondition to contract formation. See Loop Paper Recycling, Inc. v. JC Horizon Ltd,. 2010 WL 1655254 (N.D.Ill.2010); Todd, Jr. v. Kohl's Dept. Store, 2010 WL 3720265 (N.D.Ill. 2010). The court wishes to express its thanks and appreciation to Sohil Shah of Polsinelli PC, recruited settlement counsel for the plaintiff, and Carl Michael Johnson and Timothy L. Swabb of the City of Chicago Law Department, counsel for defendant, and to their clients for the cooperative spirit in which they approached this case and participated in the settlement process. Their conduct is proof that lawyers can act with civility and courtesy in their dealings with opposing counsel without sacrificing in the slightest the obligations they owe to their clients.
