Status hearing set for 08/12/2015 at 9:45 a.m. In reviewing the 2011 records dispute, the Court notes (without definitively deciding) as follows: Defendant argues that the underlying records are irrelevant, but Phyllis Robinson (the purported decision-maker in the case) did write, in terminating Plaintiff, that Plaintiff was involved in the 2011 team communication failure and there was a safety risk in that failure. But the believability that Robinson did rely on that conclusion could be affected by what the underlying records show (and this is discovery, so the test is not, right now, absolute certainty of relevancy, but instead whether the request is reasonably calculated to lead to admissible evidence). Sure, the conclusion need not be actually correct (an employer cannot be liable for a mere mistake), but whether in fact Robinson did rely on that conclusion could be affected by the information in the records. In any event, the parties must confer one more time on the issue; if no agreement is reached, then Plaintiff shall file a reply brief by 08/05/2015, and the defense shall file a privilege log on that same date.
