- ilnd;;1:15-cv-01859_de10 RegisterActionDescriptionText "MINUTE entry before the Honorable Joan B. Gottschall: Plaintiff's motion to take discovery prior to Rule 26 conference 5 is granted in part. No appearance is required on 3/13/15. Plaintiff is given leave to serve a Rule 45 subpoena on the defendant's ISP pursuant to Federal Rule of Civil Procedure 26(d)(1). This provision bars a party from seeking discovery "from any source before the parties have conferred as required by Rule 26(f), except... when authorized by these rules, by stipulation, or by court order." "Rule 26 does not set forth a standard for doing so, but courts in this circuit have generally granted [motions seeking discovery before the Rule 26 conference] on a showing of 'good cause.'" Dallas Buyers Club, LLC v. DOES 1-28, No. 14-cv-4927, 2014 U.S. Dist. LEXIS 100629, at *4-5 (N.D. Ill. July 22, 2014). "Good cause exists when the need for expedited discovery, in consideration of the administration of justice, outweighs the prejudice to the responding party." Id. (quotation marks omitted). Here, plaintiff seeks to take discovery to identify the defendants. The court finds that this reasoning qualifies as good cause. However, Plaintiff is entitled only to the name and address of the defendant, not the defendant's email address or telephone number. Furthermore, the defendant will be allowed to proceed by pseudonym in this case. Plaintiff may not name the defendant publicly. It may not name the defendant in an amended complaint or any other filing with the court. The defendant shall instead be identified by Doe # or IP address. Any communication by Plaintiff to the defendant suggesting that the defendant can or will be named in this action shall constitute a violation of this court's order and grounds for dismissal of the action pursuant to Rule 41(b). Mailed notice (mjc, ) (Entered: 03/12/2015)" @default.
